Acceptance of Terms

By accessing and using Nibbleful, you accept and agree to be bound by these Terms. If you do not agree, please do not use this Service.

Description of Service

Nibbleful is a usage-priced backend platform that helps users:

• Create Organizations, Collections, and API credentials
• Store and retrieve JSON records through private and public APIs
• Meter usage against prepaid balance
• Manage team access, billing settings, and request activity

User Accounts and Responsibilities

When using our Service, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials and API keys
• Be responsible for all activities under your account and organization
• Notify us immediately of any unauthorized use
• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations

Prepaid Credits and Billing

Nibbleful is billed through prepaid organization credit. Accepted API usage and applicable storage charges debit that balance. Payments are processed by Stripe. Prepaid credits are generally non-refundable. If Nibbleful elects to issue a refund of unused credits, the refund may be reduced by non-refundable payment-processing fees, except where prohibited by law or where the refund results from a billing error by Nibbleful.

Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape in abusive ways
• To interfere with or circumvent the security features of the Service
• To attempt to access data or Collections you are not authorized to use

Content and Data

Your content

You retain ownership of the data you store using our Service. By using our Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.

Content standards

All content must be:

• Lawful and submitted with appropriate rights and permissions
• Free from illegal, harmful, or inappropriate material
• Compliant with applicable laws and regulations

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

Service Availability

We strive to provide continuous service availability, but we do not guarantee that the Service will be:

No Professional Advice

Limitation of Liability

In no event shall Brand New Ship, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless Brand New Ship, LLC and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will cease immediately.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.
